Yoko Ono sues over use of John Lennon videos

NEW YORK (AFP) - Beatle John Lennon's widow Yoko Ono is suing two companies over the rights to videos of her late husband, one of which shows Lennon smoking marijuana, composing songs and wondering if he should drug Richard Nixon.

Ono's lawsuit against World Wide Video, a consortium of Beatles collectors who claim they bought the Lennon home video from Ono's first husband Anthony Cox, is due for a preliminary hearing in a Massachusetts district court on April 30, according to court documents.

World Wide Video has filed its own lawsuit claiming ownership of the video that it has titled "3 Days in the Life," billing it as "a most intimate and no-holds-barred" look at Lennon's private life with his family and friends.

The video, shot by Cox, includes images of Lennon smoking marijuana, speculating about lacing then-US president Richard Nixon's tea with LSD, and composing songs including "Remember" and "Mind Games."

"Our film allows a new generation to share with those who lived through those times, a deep and penetrating look at the many sides of the man who set new standards in art, music, fashion and politics," company executive producer Ray Thomas said in a statement.

In a separate lawsuit filed here in a Manhattan federal court, Ono claims Premise Media and Rocky Mountain Pictures used a video clip of Lennon singing "Imagine" without her approval.

The clip is included in "Expelled: No Intelligence Allowed," a documentary that questions Darwin's theory of evolution.

Ono maintains that the documentary's credits could mislead viewers about her having authorized Lennon's clip.

Premise Media and Rocky Mountain Pictures said in a statement that they only used "a very small portion of the song."

Wasn't even Michael Shermer refused permission to quote from the song even for a book aligned with John Lennon's ethos?

Additionally, I can't help thinking that the stuff about John Lennon wondering if he should spike Nixon's tea is reported inaccurately here. I can imagine Lennon saying this as a joke, but I can't bring myself to believe he really intended to do it, whether or not he was smoking cannabis.
This reminds me of Hitchens' comment that the "literal mind cannot comprehend the ironic mind."

(I do however think it is a little ironic that a song that asks us to "Imagine no possessions" is being sued over. Maybe it's ok if it's against someone working against a "brotherhood of man" like Ben Stein.)

In this case, Lennon's Imagine.

I'm reminded of Cuozzo's cave art debacle in France, and when he recklessly trespassed on private property to reveal to the world the Neanderthal sculpture of a mammal in combat with a dinosaur.

This required some immagination in fact as it was a natural formation, if I'm not correct.

ROTFL. You just cannot make this stuff up can you.

Will that match "the very small portion of truth in Expelled".

It does not matter one jot how much of a clip, picture, song or quote you use if it breaks 'fair use' rules.

Take em' to the cleaners - after all the umbrella organizations pushing Expelled have deep pockets.

Actually, Dawkins, Myers, Shermer, and others who appear in "Expelled" might be able to sue the film's makers if they want. As far as I've heard, these guys and others had contracts to appear in the movie, and it seems that the only reason they agreed to do the film was because of the lies that the producers told them about the movie's purpose. That could be the basis for a case of misrepresentation under either contract or tort law in the US. Of course, it depends on the circumstances, contract language, etc.

I'm sure they don't want to give the film anymore publicity than it has now. Although, if they wait until the movie is out of the spotlight, it might be worth it if they can make a case.

Hi, I followed Lionel's link to the scumsuckers myspace. It's like a black hole of wilful ignorance.

However, the poll is overwhelmingly against them. 9000 plus as against only 600 or so. Seems like the saddoes who are "friends" can't use myspace polls.

The crawthumping triumphalism in the comments is hurl-inducing, however.

Some of the best research and commentary on the Expelled lawsuits suddenly goes down? Article after article about the copyright issues, lawsuits, etc. just happens to go down now? Funny that Expelled is trying to argue that ideas are being surpressed by scientists.
