DPB, no civil rights issue in the history of the US has been granted by a vote of the people but through the courts. Prop 8 was an undermining of the Supreme Court of California. The reason Califonria was targeted so heavily by the religious nutters was to overturn a state Supreme Court ruling. They could have spent their money in Arizona or Florida. Prop 8 was not just an attack upon gays and lesbians but also an entire branch of government and that should scare the hell out of everyone.

DPB, I agree with you on everything except that "it was fair in the sense that they let people decide on it". Civil rights should never be placed up for a popular vote. It is wrong under every circumstance to cast a ballot against your neighbor, friends, family, co-workers or the 55,000 children being raised by same-sex couples in the State of California.

Bernstein, The California Supreme Court says that gays and lesbians are a "suspect class" of people that are to be protected from discrimination. You now know more than the court? Should the state deny lesbians a fishing license because it's a redefinition of the sport of fishing? After all, historically it's an all male sport. Bernstein, When Jews were barred from practicing law, would you have accused them of "redefining" the legal system? When Armenians were denied from buying houses in the San Jaoquin Valley, would you have accused them of "redefining" property owners rights? When interracial couples were denied the right to marry and their relationships were called "illicit sex", did they "redefine marriage"? Two water fountains were present in the Jim Crow south when separate was considered equal and the argument was made that it all comes from the same source of water. Civil Unions are not equal and marriage is for everyone regardless of gender.

Bernstein, When Jews were denied from practicing law and were told that being a legal assistant is good enough for them, would you have accused them of trying to "redefine" the legal system? In 1964, there was a ballot initiatvie called California Prop 14 that would allow landlords and property owners the legal right to discriminate based upon race to protect white neighborhoods from encroachment by blacks. The California Republican Assembly leader at the time wrote "the essence of freedom is the right to discriminate.... In socialist countries, they always take away this right in order to complete their takeover." Prop 14 passed with over 60% of the vote. A legally guaranteed right under the California constitution was revised by the will of the people to target an unpopular minority. It wasn't until 1967 that the US Supreme Court had to intervene and protect the rights of a suspect class of citizens from a popular vote of the people. Prop 8 does the same thing. In May, the California Supreme Court elevated gays and lesbians to a protected suspect class of people with their right to marry ruling. Prop 8 did not take away the suspect class ruling of the court. If you are so concerned about a redefinition of marriage, take your argument to the editors of your favourite dictionary and keep the fuck out of my constitution!
